Terms and Conditions

These terms and conditions are explained at a video available here.  You may watch the video to help you understand.  You may also turn on the closed captions (CC) in your own language to help you understand.

IMPORTANT: These are provided to help you understand but where there is any difference between the video and/or and closed captions and the Terms and Conditions on this page, the Terms and Conditions on this page will apply.

Student Agreement Terms and Conditions (updated 7th November 2019)

All students must sign a Student Agreement each Term. The following Terms and Conditions form part of the Student Agreement.

The original Agreement will be kept by the Company and the Company will email the student a copy for reference. 

Definitions:

Company: Ty-Jia English Language School Pte. Ltd. 

School:  All references to ‘School’ include the Company and/or its employees. 

The Student: Any person who has entered into an Agreement to take a course with the Company or whose Parent/Guardian has entered into an Agreement on his/her behalf. The Student shall comply with all the obligations of the Student under this Agreement and any non compliance on the Student’s part shall be deemed as a breach of this Agreement by the Student or by the Parent/Guardian as applicable

Premises: 20 Upper Circular Road, 01-33 to 35, The Riverwalk, Singapore, 058416 or any other Premises to which the Company relocates

Class: A group of students attending regular lessons in a specific course/level

Course: Communication, General, Business or Academic English or any other Course that the Company may from time to time introduce. 

Lesson: A 55-minute session with an assigned day and time. 

Workshop: A stand-alone session that may or may not be of the same duration, at the same time as a Lesson.

Level: Assigned based on English ability. From low to high they are: Starter, Basic, Elementary, Pre-Intermediate, Intermediate, Upper Intermediate and Advanced with each level subdivided into 1, 2, 3 and 4 where one is the lowest and four the highest.

Term: There are 4 terms in a year. Each term is 12 weeks long. 

Regular Courses: These are courses that have two x 55-min lessons per week. Regular courses run for 12 weeks and follow the format of 10 weeks of Lessons, 1 week of assessment and feedback (during Lessons) and 1 week of workshops.

Intensive Courses: These are courses that have two x 55-min lessons per day, 5 days a week. Intensive Courses run for 2 weeks.

Open-door period: The 10-minute period after the break time and immediately before the class begins.  The teacher will be available in the classroom for general chat or questions.

Break-time: The break time between classes. Your teacher may not be available during this time.

Agreement:

  1. Course, Class, Level and Lesson
    1. Courses, Classes, Levels and Lessons will be mutually agreed between the Student and the Company according to Student level and availability.
  2. Payment
    1. Lesson Fees are payable in advance without demand before beginning the course. Payment must be either online or at the reception counter. Students who chose to pay installments online agree that subsequent payments will be automatically deducted at monthly intervals until payment is complete
  3. National holidays
    1. There are no lessons on Singapore National holidays or Company holidays unless otherwise specified in the Student Agreement. The Company Calendar is available here.
  4. Student Absence
    1. The Student must inform the Company in advance of any Lesson absences in writing. Repeated absence without informing the Company in writing may be considered a breach of this Agreement and may result in termination as per Clause 11.1.
    2. Students forfeit any lesson(s) missed and are not entitled to refunds or make-up lessons.
  5. Lesson cancellations by the Company
    1. The Company reserves the right to cancel lessons for any reason. 
    2. When a Lesson is cancelled the Company and the affected Students will endeavour to find a mutually agreeable alternative lesson time.
    3. Where a mutually agreeable alternative Lesson cannot be arranged for any reason, a pro-rated refund for the affected Lesson will be given within fourteen working days of the cancelled Lesson date if applicable.
  6. Lesson Catch-ups
    1. Following a missed lesson, students will be able to use the open-door period in the 10 minutes immediately preceding their next class to ask any questions. The teacher will address any questions and/or explain missed content from the previous class only if the following conditions are met:
      1. The Company was informed in writing in advance of the absence.
      2. The Student checks the Google Classroom post for the missed class, reads the missed textbook pages and attempts any homework that has been assigned before the open-door period.
      3. There has not been another open door period on the same day for the same class, i.e. there will be a maximum of one open-door period per day per class.
      4. The Course has Lessons that take place at least twice a week
  7. Teacher and Course materials
    1. A suitable teacher and textbook will be assigned to each Student by the Company. The teacher and/or textbook may be changed anytime if deemed necessary by the Company. 
    2. The Student must purchase the appropriate textbook either directly from the Company or independently. Save for temporary use while waiting for ordered textbooks to arrive, the Student may not use photocopied, photographed or scanned versions of textbooks.
    3. All students must have a Gmail account in order to access lesson resources.
  8. Responsibilities of the Company
    1. The Company will:
      1. prepare and conduct level-appropriate lessons for and assessments of the Students. 
      2. set homework for Students as required
      3. provide the following at additional cost on the request of the Students: Marking of student work outside lesson times
  9. Attendance lanyard
    1. On arrival for the Student’s lesson, the Student must register at the reception counter and will be given a coloured lanyard.  The lanyard must be worn at all times while on the Company premises. In order to protect the Student’s privacy, Students may choose a red lanyard to show that they do not wish to be included in any photos taken on the premises. Students selecting a green lanyard give their consent for their photos to be published both on- and offline for both marketing purposes and/or for the production of learning publications. Students may change their lanyard at any time, even during the course of a lesson. 
  10. School property
    1. Students may borrow library materials free of charge.  All books must be signed in and out. Lost or damaged books will be charged at $25 per book.  
    2. Students who damage School property will be charged at cost for the repair or replacement of the damaged item or device.
  11. Termination
    1. If and when the Student, loses his/her legal right to stay in Singapore or engages or takes part in any behaviour that, in the view of the Company, is gross misconduct or endangers the safety or lives of other Students or Company personnel, or has a negative impact on the learning of other Students, or does anything that amounts to repeated breaches of this Agreement, the Company may in its sole discretion terminate this Agreement immediately.
    2. If the Company wishes to terminate this Agreement for any reason apart from those provided elsewhere in this Agreement, then the Company must give the Student at least three working days’ written notice. 
    3. Ty-Jia English Language School will provide the Student with a Cooling-off Period of 7 working days after the date that the Student Agreement has been signed by both parties in case the Student changes his/her mind and wishes to cancel the Agreement.
    4. Ty-Jia English Language School will provide the Student with Special Consideration when the Student is requesting to terminate in the event of unforeseen circumstances such as the death of a close family member. 
    5. If the Student wishes to terminate this Agreement for any reason apart from those provided elsewhere in this Agreement, then the Student must give the Company at least three working days’ written notice.
  12. Refund Policy
    1. Company-initiated termination:
      1. If the Company terminates this Agreement pursuant to Clause 11.1. above, there will be with no refund, partial or otherwise to the Student.
      2. If the Company terminates this Agreement pursuant to Clause 11.2. above or if the Company needs to terminate any Course in which the Student is studying, then the Company will give at least three working days’ prior written notice to the Student. The Student will be informed in writing of alternative study arrangements (if any), or be entitled to a refund of any unused portion of the affected Lesson Fees within fourteen working days of the above notice.
    2. During Cooling-Off Period or due to Special Considerations:
      1. If the Student submits a written notice of withdrawal to the Company within the cooling-off period (Clause 11.3), or is permitted by the Company to withdraw under the Special Consideration Clause (Clause 11.4), regardless of whether the Student has started the course or not. The Student will be refunded Course Fees already paid, less the following:
        1. a $100 administration fee, 
        2. any lessons already taken and 
        3. any textbooks already issued to the Student
    3. Student-initiated termination: 
      1. Save for the Cooling-off Period and Special Consideration provision, there will be no refund for Student-initiated terminations of this Agreement.   
      2. Save for the Cooling-off Period and Special Consideration provision, for Students who are paying by installments, any remaining payments will be still be payable.
  13. Limitation of liability and consent
    1. The Student acknowledges that while the Company will take all reasonable measures to guide the Student in his/her behaviour, they will not be liable for any damages, accident, injury, or death or for the loss of any personal belonging of the Student.
  14. General
    1. This Agreement shall be governed by the laws of Singapore. The Parties agree to submit to the exclusive jurisdiction of the courts of Singapore.  This Agreement constitutes the entire Agreement and understanding between the Parties, and supersedes all prior understandings and Agreements between them, with respect to the subject matter of this Agreement. Waiver of any provision hereof or a breach thereof shall not constitute a waiver of any other provision or of any future breach or breach of any other provision or operate as a continuing waiver. No modification of this Agreement shall have any effect unless such modification is in writing, signed by both Parties.
    2. If any part of this Agreement is not valid for any reason under the law of Singapore, this will not affect any other part of this Agreement.
    3. All personal information given by the Student to the School will not be given by the School to anyone else, unless the Student signs in writing that he/she agrees or unless the School is allowed to give the information by law.
    4. If this Agreement is also signed or translated in any language other than English and there is a difference from the English language copy of this Agreement, the English language copy will apply.
